Name of Society

The name of the Society you wish to form and register must be unique and not identical or too similar to that of any existing registered Society within the same jurisdiction. If a Society with the desired name already exists, you will need to choose an alternative. To avoid delays or rejection, it is recommended to submit three proposed names when applying for registration.

Jurisdictional Limitations:

  • In some states, the restriction on using a similar name applies only within the same district.
  • In others, the limitation extends to the entire state, meaning no two societies can have identical names across that state.
  • In Union Territories, the name of a Society must not resemble that of any other registered Society within the entire Union Territory.

Name Must Not Resemble Government Entities

The name of the Society must not be identical or similar to the name of any Government ministry, department, authority, or organization. Names or words prohibited under the Emblems and Names (Prevention of Improper Use) Act, 1950 are strictly not allowed. The concerned Registrar will reject any application that includes government-related names or emblems to prevent misuse or public confusion.

Registered Office of the Society

The Registered Office of the Society must be provided along with valid address proof and a No Objection Certificate (NOC) from the property owner. The NOC should be prepared on a ₹10 stamp paper and accompanied by ownership proof of the premises. All these documents must be notarized by a Notary Public to ensure their authenticity and legal validity.

Working Area, Jurisdiction, and Status of the Society

It must be clearly specified whether the Society will function as a national-level (All India) organization or a state-level organization. A minimum of seven adult members is required to form a Society.

For registering a national-level Society, there must be seven promoters from seven different states of India, ensuring representation and eligibility to operate across the country.
